Pre-Termination Checklist
  • Is the employee a member of a protected class?
  • Do our published policies limit our scope of action?
  • Is there an employment contract - written or implied?
  • Have we interviewed the employee?
  • Has an independent source been consulted, e.g., human resources, legal counsel?
  • Is our decision the result of a fair and proper procedure?
  • Will any documents generated help us in court?
  • Are there any public policy issues?
  • Would termination prevent vesting of benefits in the relatively near future?
  • Have we considered alternatives short of discharge?
  • Are we letting the employee leave with dignity?
